On April 29, Pennsylvania Supreme Court entered judgment in favor of the Chester Water Authority, entitling it to communications among the Commonwealth’s Department of Community and Economic Development, the private firm appointed as Act 47 coordinator, Econsult Solutions, Inc. and its various subcontractors, regarding their secretive attempts to sell CWA to private interests over the objections of CWA and its ratepayers.
After nearly four years of litigation, the Supreme Court ruled that such communications are not exempt from disclosure as the DCED had argued, the records are public—and not subject to any legal exception from disclosure.
